General Data Protection Regulation

Balance Motor Works use no third party cookies. We use no advertising cookies. We only use Google for analytics and your IP address is anonymised. We do not undertake remarketing so you won’t get emails about a basket you’ve abandoned or other irritating marketing.

New GDPR regulations came into force in May 2018.

Balance Motor Works will comply both with the spirit and law of the regulations.

The regulations state

“The processing of personal data should be designed to serve mankind. The right to the protection  of personal data is not an absolute right; it must be considered in relation to its function in society and be balanced against other  fundamental rights,  in  accordance with  the  principle of  proportionality.  This  Regulation respects all fundamental rights  and  observes  the  freedoms and  principles recognised in  the  Charter  as  enshrined  in  the Treaties, in  particular the  respect for  private  and  family life,  home and  communications, the  protection of personal data, freedom of thought, conscience and religion, freedom of expression and information, freedom to conduct a  business, the  right  to  an  effective remedy and  to  a  fair  trial,  and  cultural, religious and  linguistic diversity. “

That is a small snippet of an 88 page document. It’s a hugely complicated beast but as a small business we must still comply.

What is important is Balance Motor Works must have a valid lawful basis in order to process personal data.

Our valid lawful basis is that we are engaged in the sale of services (and parts) which require us to take customer name and address details. However we do not do this via our website which is for information purposes only. Any data we hold offline is for administration purposes. We do not sell the data to any other company, nor allow any other company to use the data. However the data may be passed to third parties to enable the contract fulfillment (for example if we have to send a part to you by mail order).

The legal basis that apply are:

(b) Contract: the processing is necessary for a contract you have with the individual, or because they have asked you to take specific steps before entering into a contract.

We need your name & address and phone number to ensure we can verify the payment card is legitimate and to facilitate the contract of sale of our services (and/ or goods). If you do not wish for your data to be stored you may ask us to remove your data.

Please note we never store card details or other financial information at any stage. In addition we do not ask for information that is unnecessary such as date of birth or mothers maiden name. Only a name, address and phone number is stored, as well as your car registration where applicable.

We are not registered with the ICO as we only process personal data for our core business purposes.

We store only your address & name, no payment details are stored. If you wish to have your details removed or see what information is held,  please email a written request. There is a £5 administration fee payable. HMRC rules insist we keep sales records for 6 years. Although after this time we do not routinely remove data, it may be that the data is no longer valid (for example you may have moved house). After 6 years if you wish to have data removed please contact via email.
